1. INTRODUCTION AND ACCEPTANCE OF TERMS

These Terms of Use (“Terms”) govern access to and use of the website, digital platforms, content, subscriptions, and experiences offered under the brand Nalaya Retreats (“Nalaya,” “we,” “us,” or “our”).

By accessing, browsing, registering, purchasing, or participating in any Nalaya service, you (“User,” “Participant,” or “you”) expressly acknowledge that you have read, understood, and agreed to be legally bound by these Terms, without limitation or qualification.

If you do not agree with these Terms, you must not use the website or any services provided.

2. SCOPE OF SERVICES

Nalaya Retreats provides:

Informational and educational content (articles, videos, audio, written materials)
Digital subscriptions and community memberships
Online and offline workshops, programs, and experiential retreats
Integrative practices including (but not limited to): meditation, breathwork, movement, sound, creative expression, group processes, and ancestral or traditional practices
Access to third-party facilitators, collaborators, or service providers

Nalaya does not provide medical, psychological, psychiatric, therapeutic, or healthcare services.

3. NO MEDICAL OR PSYCHOLOGICAL ADVICE

All content and experiences offered by Nalaya are educational and experiential in nature only.

Nothing provided by Nalaya constitutes medical advice, diagnosis, treatment, psychotherapy, or mental health care.
Nalaya does not replace licensed professionals.
Users are solely responsible for consulting qualified healthcare providers before participating in any activity offered.

You expressly acknowledge that you participate voluntarily and at your own risk.

4. ELIGIBILITY AND USER RESPONSIBILITY

By using Nalaya services, you confirm that:

You are at least 18 years old
You are legally capable of entering binding agreements
You are in sufficient physical, emotional, and mental condition to participate
You have disclosed any relevant conditions when requested
You take full responsibility for your participation, decisions, reactions, and outcomes

Nalaya reserves the right to deny access to any service at its sole discretion.

5. ASSUMPTION OF RISK

Participation in Nalaya experiences may involve inherent risks, including but not limited to:

Emotional discomfort
Physical exertion
Psychological introspection
Unexpected reactions to practices, environments, or group dynamics

By participating, you voluntarily assume all known and unknown risks, even those arising from negligence, environmental factors, or actions of third parties.

6. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

Nalaya Retreats, its founders, directors, officers, employees, facilitators, contractors, partners, and affiliates shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages.
This includes, without limitation, injury, illness, emotional distress, financial loss, lost profits, reputational damage, or personal dissatisfaction.

Total liability, if any, shall not exceed the amount paid by you for the specific service giving rise to the claim.

7. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Nalaya Retreats and all associated parties from any claims, losses, damages, liabilities, costs, or expenses (including legal fees) arising from:

Your participation
Your breach of these Terms
Your violation of applicable laws
Your interactions with other participants or third parties

8. THIRD-PARTY SERVICES AND FACILITATORS

Some services may be delivered by independent third parties.

Nalaya does not control or guarantee third-party actions, opinions, or conduct
Any dispute with third parties is solely between you and them
Nalaya disclaims all liability related to third-party services

9. PAYMENTS, SUBSCRIPTIONS, AND REFUNDS

All prices are listed in the applicable currency and may change without notice
Subscriptions renew automatically unless cancelled
Retreats, programs, and experiences are generally non-refundable, unless explicitly stated otherwise
Nalaya may cancel or modify services due to force majeure or operational reasons

10. INTELLECTUAL PROPERTY

All content provided by Nalaya, including text, video, audio, branding, logos, designs, and materials, is protected by intellectual property laws.

You may not copy, distribute, modify, reproduce, or exploit any content without written permission
Access does not transfer ownership

11. USER CONDUCT AND COMMUNITY GUIDELINES

Users agree not to:

Disrupt, harass, or harm others
Misrepresent identity or intentions
Share confidential group information without consent
Use the platform for illegal or unethical purposes

Violation may result in immediate removal without refund.

12. CONFIDENTIALITY AND GROUP SPACES

Experiences may involve group sharing.

You agree to respect the confidentiality of others
Nalaya is not responsible for breaches committed by participants
Participation implies consent to group dynamics and shared spaces

13. DATA PROTECTION AND PRIVACY

Personal data is processed in accordance with Nalaya’s Privacy Policy and applicable data protection laws (including GDPR where applicable).

14. DISCLAIMER OF GUARANTEES

Nalaya makes no guarantees regarding:

Outcomes
Transformations
Healing
Longevity
Personal results

All experiences are subjective and individual.

15. FORCE MAJEURE

Nalaya shall not be liable for failure or delay due to events beyond reasonable control, including natural disasters, governmental actions, illness, or other unforeseen circumstances.

16. TERMINATION

Nalaya reserves the right to suspend or terminate access at any time for breach of these Terms or at its sole discretion.

17. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of Colombia, without regard to conflict of law principles.

Any disputes shall be subject to the exclusive jurisdiction of the competent courts of that jurisdiction.

18. SEVERABILITY

If any provision is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

19. ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and Nalaya Retreats and supersede all prior communications or understandings.
